** available at any time of day and in time increments convenient to you through date referenced above **, together with Houston Bar Association (HBA), are pleased to present a special online CLE program in the area of legal ethics. While all attorneys, whether they are involved in transactional or litigation work, face myriad ethical issues, attorneys representing civil and criminal defendants can face a host of ethical situations that often appear without warning and from unexpected individuals and directions. The pressures of both representing one’s client diligently and professionally, of attempting to achieve a just and, where possible, cost-efficient resolution of the dispute, and of maintaining one’s professional independence and integrity can affect and complicate the tactics and strategy, and ultimately the outcome, of the matter, sometimes fatally for the attorney and/or the client. Urgencies in defensive litigation may pose particular obstacles when the practitioner needs at all times to comply with the paramount requirements of the Disciplinary Rules of Professional Conduct (“the Rules”). This course features a streaming video and a downloadable MP3 audio presentations from a live CLE seminar on this topic that was originally conducted by the Houston Bar Association on February 21, 2015. You can access this presentation on demand at any time during the course of the seminar session. This course is approved for 1.00 MCLE credit hour in legal ethics.

  • The Role and the Problem with Lawyers

  • Keeping the Rules in Mind

  • The speaker for this course is James J. Burnett has been a commercial trial lawyer for more than thirty-four years, representing businesses and business people in a wide variety of civil commercial cases in state and federal courts throughout Texas, in federal courts in Arizona and California, and in state court in Florida, particularly in the chemical, energy, health care, and technology fields and before local, state, and federal administrative and regulatory agencies. He has represented entities ranging from small privately held companies to publicly traded enterprises with national and international operations. His extensive experience in energy included defending oil and gas exploration subcontractors in forty-six simultaneous lawsuits throughout Texas. Those cases involved more than six hundred plaintiffs seeking more than eighty million dollars in damages jointly and severally from the defendants. James obtained summary judgments, directed verdicts, or trial verdicts in every case. The courts of appeal upheld all the outcomes. A more extensive biography, including additional information about the educational background and professional associations, for Mr. James Burnett may be found at his firm's website.
