Judge Lupe Salinas of Texas Southern University-Thurgood Marshall School of Law poses a serious question in his article which was recently referred to in the Supreme Court's opinion of Baze v. Rees by a critical Justice John Paul Stevens. Salinas argues that, based on the history of doubtful and arbitrary executions, the answer could easily be 'Yes.' The death penalty in America has done little to deter or prevent those inclined to kill from killing. However, considering the political realities of the electorate, Salinas realizes that with a Supreme Court that has been carefully structured in its representation, the answer is more likely 'No,' an assessment affirmed in Baze. In this seminar, Salinas urges adoption of a higher burden of proof at the penalty stage of a capital murder trial if the states continue to use the death penalty.

Professor Lupe Salinas, who is a law professor at Texas Southern University-Thurgood Marshall School of Law in Houston. Prof. Salinas previously served as a state district judge in Houston (1989-2006). He also served as Chief of the Federal Trial Division of the Harris County Attorney's Office (1985-88), and Chief of the Civil Rights Division in the U.S. Attorney's Office in Houston (1980-83). He is a member of the State Bar of Texas and the Houston Bar Association. He is a frequent author and speaker on various issues of criminal law and criminal procedure. He received his law degree from the University of Houston Law Center (J.D., 1972) and his undergraduate degree from the University of Houston, (B.A., 1970).
