Additional Description:

CLEonline.com is pleased to present a special online ethics seminar that helps lawyers determine whether to retain an expert on the Texas Disciplinary Rules of Professional Conduct when filing a breach of fiduciary duty claim against another lawyer. Breach of fiduciary duty claims against lawyers in Texas have increased due to favorable case law and perceived advantages to that claim over others that could be brought against lawyers. Unlike some other claims against lawyers, though, expert testimony may not be needed or even permitted in a breach of fiduciary duty claim. Expert guidance, however, may be advisable unless the lawyer bringing the claim is already expert in handling fiduciary duty claims.

This seminar features an audio presentation and a PowerPoint presentation by the instructor/moderator for this seminar, Lillian B. Hardwick, in which she discusses the issues outlined below. The accompanying paper tracks and expands upon the legal references, while the audio presentation follows the PowerPoint presentation so as best to convey the practical aspects of the material. This is a streaming audio presentation that you can access on demand at any time during the course of the seminar session. The audio presentation lasts for approximately 1.0 hour. This seminar is entitled:
