CLEonline.com, together with the Houston Bar Association, are pleased to present a special online CLE program in the area of patent laws. You've just received a letter demanding your client take a patent license or cease-and-desist its infringing conduct. What should you advise your client? This seminar will discuss how to handle this situation for non-IP or new IP attorneys, an overview of covenants to non-competes in Texas and the impact by the Texas Uniform Trade Secrets Act. This course features a streaming video and a downloadable MP3 audio presentation from a live CLE seminar on this topic that was originally conducted by the Houston Bar Association (HBA) on February 12, 2015. You can access this presentation on demand at any time during the course of the seminar session. This course is approved for 1.50 MCLE hours.

Some of the subjects to be discussed during this course include:

  • Initial Analysis and Response

  • Patent Litigation Basics

  • New Post-Grant Proceedings

  • Recent Developments from the Supreme Court and Federal Circuit

  • Proposed Legislation

The speaker for this course is Mr. James H. Hall, an attorney and managing principal with the Wong, Cabello, Lutsch, Rutherford & Brucculeri LLP in Houston. James Hall's practice concentrates on intellectual property litigation and related proceedings. He has experience in copyright, trademark, trade secret, and patent litigation. His primary focus is on patent litigation and associated post-grant practice in the United States Patent Office. He has represented patent owners and accused infringers in both Federal court and before the Patent Trial and Appeal Board. Mr. Hall has substantial experience with every aspect of complex litigation, including discovery, motion practice, Markman hearings, mandamus proceedings, and appeals. He has taken lead briefing roles in many successful motions and appellate briefs, and participated in multiple successful discovery, Markman, and injunction hearings. He has also taken or defended over fifty fact and expert depositions, and has assisted many experts in preparing cases for trials in court and the Patent Office. He is admitted to practice in all state courts in Texas and Arkansas, the U.S. District Court for the Southern District of Texas, U.S. Patent and Trademark Office, and U.S. Courts of Appeals for the Third, Eleventh and Federal Circuits. He is a member of the State Bar of Texas, Houston Intellectual Property Lawyers Association, and the Houston Bar Association. He received his law degree from the University of Houston Law Center. A more extensive biography for Mr. Hall may be found on his firm's website.
